रियल एस्टेट की कीमतों को बढ़ाने वाला सबसे संभावित कारक यही है कि काला धन जमा कराने वाले लोग अपने पैसे का निवेश इस क्षेत्र के अलावा कहीं और आसानी से नहीं कर पाते। इसका तर्क सीधा है जो भी चीज कैश इकोनॉमी की राह में बाधा डालती है वह रियल एस्टेट की गतिविधियों और उसकी कीमतों पर असर डालेगी। यह प्रभाव तत्काल ही नजर आने लगा था। देशभर में रियल एस्टेट का काम तत्काल रुक गया। इसके बाद कुछ गतिविधियां शुरू हुईं लेकिन इनकी रफ्तार बेहद कम थी। वास्तव में यह एक अपारदर्शी बाजार है और वास्तव में यह अपारदर्शिता पर ही फलता-फूलता है। इसलिए वास्तविक सूचना लंबी अवधि में मिलेगी। रियल एस्टेट में जो विक्रेता कीमतें मांग रहे हैं, वे तेजी से नीचे आने लगी हैं।


सामान्य स्थिति में अर्थव्यवस्था के संबंध में विकास केंद्रित चर्चा करने पर रियल एस्टेट में कीमतों में गिरावट को विमुद्रीकरण का नकारात्मक असर माना जाएगा। हालांकि करोड़ों भारतीय जो खुद का मकान खरीदने में सक्षम नहीं हैं, उनके लिए यह अच्छा अवसर है। प्रधानमंत्री ने भी अपने उस भाषण में आम लोगों की मकान खरीदने में अक्षमता की वजह काला धन करार दिया था। नोटबंदी के बाद रियल एस्टेट उद्योग ने ऐसी खबरें दी हैं जिससे लगता है कि विमुद्रीकरण किस तरह रियल एस्टेट के लिए अच्छा साबित होगा। कई रियल एस्टेट डेवलपर्स वाट्सऐप मैसेज के माध्यम से लोगों को मैसेज भेज भेजकर फोन के इनबॉक्स को भर रहे हैं। उनके मैसेज का मूलमंत्र यह होता है कि ब्याज दरें नीचे आएंगी जिससे लोग अधिक उधार ले सकेंगे। यह भी कहा जाता है कि सवा अरब की आबादी वाले देश में 90 करोड़ लोग ऐसे हैं जिन्हें मकान की आवश्यकता है। यह भी कहा जाता है कि निवेशकों को बैंक जमा पर 5 से 6 प्रतिशत ब्याज के बजाय निवेशकों को प्रॉपर्टी पर रिटर्न प्राप्त करना फायदेमंद होता है। एक तरह से यह सब सत्य है। कई करोड़ लोग ऐसे हैं जो मकान मालिक बन सकते हैं। हालांकि तात्कालिक चुनौतियां पूरी तरह भिन्न हैं।


भारत में रियल एस्टेट क्षेत्र में विश्वास का अभाव है। देशभर में हजारों डेवलपर्स हैं जिन्होंने ग्राहकों से पैसा उधार लिया है और जो उन्होंने जमीन खरीदने में लगा दिया है। अब वे कह रहे हैं कि उनके पास उस मकान को डिलीवर करने के लिए पैसा नहीं है जिसके लिए वे पहले ही भुगतान ले चुके हैं। भविष्य में इन डेवलपर्स पर गहरा संकट आने की संभावना है। रियल एस्टेट कानून जो राज्यों में लागू होने वाला है, उससे डेवलपर्स ग्राहकों के पैसे से नई परियोजनाएं शुरू नहीं कर पाएंगे। इससे अंधाधुंध ढंग से परियोजनाएं शुरू करने की प्रवृत्ति रुकेगी। इसके साथ ही जीएसटी भी लागू हो जाएगा जो कैश के जरिये कारोबार के वित्तीय मॉडल को बदल देगा। इस तरह विमुद्रीकरण, रियल एस्टेट कानून और जीएसटी का मिलाजुला असर यह होगा कि इससे रियल एस्टेट उद्योग को जबरन बदलाव के लिए तैयार होना पड़ेगा।


मकानों की वास्तविक कीमतें रहने के लिए मकान खरीदने वाले लोगों की मांग के आधार पर तय होती हैं। इसका एक सीधा नियम यह है कि मकानों की कीमतें सालाना किराये से 20 से 30 गुना होनी चाहिए। इसका मतलब है कि देश के किसी भी भाग में कीमतें इस फॉर्मूले के मुकाबले अधिक होंगी। हालांकि बदलावों को देखते हुए ऐसा होना स्वाभाविक है। यह समाचार उन लोगों के लिए बुरा हो सकता है जो इस तिमाही की उस तिमाही से विकास दर को माप रहे हैं लेकिन अंत में यह अच्छा समाचार साबित होगा। आखिरकार जो लोग मकान चाहते हैं उनकी मांग वास्तविक है। जो बात काल्पनिक है वह यह है कि भारत का रियल एस्टेट उद्योग कीमतें वास्तविक ग्राहकों को ऑफर कर रहा है।

कैसे मिलेगा फायदा:
10 साल तक फिक्सड रिटर्न की गारंटी 7.5 लाख रुपए तक के डिपॉजिट पर ही मिलेगी। अच्छी बात यह है कि अगर इस अवधि मेंबैंक इंटरेस्ट रेट घटाते भी हैं तो भी वरिष्ठ नागरिकों की डिपॉजिट पर इंटरेस्ट रेट नहीं घटेगा। साढ़े सात तक की रकम पर वरिष्ठ नागरिकों को आठ फीसदी का ब्याज दिया जाएगा।

हाउजिंग फाइनैंस कंपनियों ने रेग्युलेटर नैशनल हाउजिंग बैंक (NHB) के साथ हुई मीटिंग में पिछले महीने की शुरुआत में घोषित किए गए डीमॉनेटाइजेशन के चलते रियल एस्टेट सेक्टर में दबाव को कम करके बताया। लेकिन, उन्हें डर है कि कन्ज्यूमर सेंटीमेंट कीमतों में गिरावट की उम्मीद कर रहा है, जो आने वाले महीनों में होम सेल्स पर असर डालने के साथ ग्रोथ को कमजोर कर सकता है। घटनाक्रम की जानकारी रखने वाले कई सूत्रों ने यह बात इकनॉमिक टाइम्स को बताई है।

डीमॉनेटाइजेशन के असर का आकलन करने के लिए पिछले दो हफ्तों में NHB ने दिल्ली, मुंबई और चेन्नै में 81 हाउजिंग फाइनैंस कंपनियों के साथ तीन मीटिंग्स की है। नेशनल हाउजिंग बैंक के सीईओ श्रीराम कल्याणरमन ने इकनॉमिक टाइम्स को बताया, ‘डीमॉनेटाइजेशन के बीच स्थिति का आकलन करने के लिए हमने हाउजिंग फाइनैंस कंपनियों की रीजनल लेवल कॉन्फ्रेंस की है।’ उन्होंने बताया, ‘हमने इस सेक्टर में चुनौतियों, अवसरों के बारे में और हाउजिंग फाइनैंस कंपनियां (HFC) कैसे 2022 तक सभी लोगों के लिए घर के लक्ष्य को पूरा करने की दिशा में काम कर सकती हैं, इस पर विचार-विमर्श किया गया है।’

कल्याणरमन ने चुनौतियों के बारे में विस्तार से नहीं बताया, लेकिन मीटिंग में हिस्सा लेने वाले कुछ लोगों ने बताया कि उन्होंने रेग्युलेटर का ध्यान कीमतें घटने को लेकर कन्ज्यूमर की बढ़ती उम्मीदों की ओर खींचा। एक बड़ी HFC के हेड ने बताया कि रेंटल यील्ड और मॉर्गेज लोन यील्ड में करीब 3.4 फीसदी (टैक्स अडजेस्टेड) की गिरावट आई है, जो अभी किराये के घरों में रहने वाले लोगों की तरफ से हाउजिंग डिमांड को बढ़ाने में अहम भूमिका निभा सकता है।

कई कन्ज्यूमर्स ने फिलहाल घर खरीदने के अपने फैसले को रोक रखा है, क्योंकि वह कीमतों में गिरावट की उम्मीद कर रहे हैं। उनका कहना है कि इसका असर होम लोन डिमांड पर पड़ सकता है, ऐसी कयासबाजी खत्म करने के लिए उन्होंने NHB के दखल की मांग की है। रेग्युलेटर का मानना है कि घरों की कीमतों में थोड़ा शॉर्ट टर्म करेक्शंस (10-15%) देखने को मिल सकता है, लेकिन असल टैक्सपेयर्स के ट्रांसपैरेंट डील्स के लिए आने पर घरों की कीमतों में तेजी देखने को मिलेगी।

केंद्र सरकार ने प्रधानमंत्री गरीब आवास योजना के तहत 52,319 और घरों के निर्माण की मंजूरी दे दी है। यह आवास शहरी गरीबों को आवंटित किए जाएंगे। यूपी में 11,286 घर बनाने की अनुमति गई है, जहां अगले साल की शुरुआत में ही चुनाव होने हैं। बुधवार को जारी आधिकारिक बयान के मुताबिक, 'हाउसिंग ऐंड अर्बन पॉवर्टी मिनिस्ट्री ने 52,319 घरों के निर्माण की मंजूरी दे दी है। इन पर 2,946 करोड़ रुपये की लागत आएगी। इसमें से 778 करोड़ रुपये केंद्र सरकार की ओर से दिए जाएंगे।'

सबसे अधिक 25,097 घर मध्य प्रदेश में बनेंगे। छत्तीसगढ़ में 8,941 और महाराष्ट्र में 3,805 आवासों के निर्माण की मंजूरी दी गई है। इसके अलावा नागालैंड में 2,422, पुद्दुचेरी में 720 और दमन में 48 आवासों के निर्माण के प्रस्ताव को पारित कर दिया गया है। अब तक शहरी आवास मंत्रालय की ओर से कुल 13,43,805 आवासों के निर्माण को मंजूरी दी जा चुकी है। इन पर 72,781 करोड़ रुपये की लागत आनी है, इसमें से 19,633 करोड़ रुपये की केंद्रीय सहायता जारी की जाएगी।

उत्तर प्रदेश सरकार ने मंत्रालय को 34 कस्बों में 11,286 आवास बनाए जाने का प्रस्ताव दिया था, जिसे मंजूरी दे दी गई। इन पर 384 करोड़ रुपये की लागत आएगी, इसमें से 160 करोड़ रुपये केंद्र सरकार की ओर से जारी किए जाएंगे।

पंजाब-हरियाणा हाईकोर्ट ने पंचकूला के एक मामले में महिला की याचिका को खारिज करते हुए अपने फैसले में स्पष्ट किया है कि ससुर की बनाई प्रॉपर्टी पर बहू हक नहीं जमा सकती है।

अदालत ने यह भी कहा है कि हिंदू अडॉप्शन एंड मैंटेनेंस एक्ट महज पति की प्रॉपर्टी पर लागू होता है, ससुर की प्रॉपर्टी पर नहीं। मामला पंचकूला निवासी एक रिटायर नेवी ऑफिसर के घर से जुड़ा है।

याचिका दाखिल करते हुए महिला ने कहा था कि उसके ससुर की याचिका पर निचली अदालत ने उसे दो माह में घर खाली करने के आदेश दिए थे। यह आदेश सही नहीं हैं, क्योंकि जब उसकी शादी हुई थी तब से लेकर अब तक वह उसी मकान में रह रही थी। इसके साथ ही इसी मकान में उसने अपनी बेटी को जन्म भी दिया।

ऐसे में यह घर हिंदू संयुक्त परिवार की परिभाषा में आता है। वहीं महिला के ससुर ने दलील दी कि मकान उन्होंने खुद अपनी कमाई से खरीदा है। ऐसे में मकान पर उनका बेटा और बहू हक नहीं जता सकते। ससुर की ओर से बताया गया कि उनके बेटे की शादी के बाद से ही बेटे और बहू के बीच विवाद शुरू हो गया था।


इसके बाद वह अपने मायके चली गई थी। बाद में वह वापस आई। फिर भी विवाद जारी रहा। विवाद से परेशान होकर उन्होंने बहू और बेटे को मकान खाली करने के लिए कहा।

बेटे ने मकान खाली कर दिया था और किराए का मकान लेकर रहने लगा था, लेकिन बहू ने घर खाली करने से इनकार कर दिया। याची के ससुर ने बताया कि बहू की इस जिद पर उन्होंने घर खाली करवाने के लिए कोर्ट की शरण ली।

निचली कोर्ट ने उनके हक में फैसला सुनाते हुए नवंबर 2015 को आदेश दिया कि बहू दो माह के अंदर घर खाली करे। दूसरी ओर याची (महिला) की ओर से कहा गया कि ससुर के घर को भी संयुक्त हिंदू परिवार के तौर पर देखा जाए, क्योंकि इसकी रेनोवेशन पर खर्च याची द्वारा किया गया था।

हाईकोर्ट ने दोनों पक्षों को सुनने के बाद मामले में दाखिल बहू की अर्जी को खारिज कर दिया। फैसला सुनाते हुए जस्टिस राजमोहन सिंह ने कहा कि ब्याह कर आई महिला की पूरी जिम्मेदारी उसके पति की होती है, न की सास-ससुर की।

यदि सास ससुर ने अपनी कमाई से प्रॉपर्टी तैयार की है, तो ऐसे में बहू उस प्रॉपर्टी पर हिंदू संयुक्त परिवार के आधीन हक नहीं जता सकती।

Government Says Rules For Real Estate Act Finalised – NDTV Profit

New Delhi: Union Urban Development Minister M Venkaiah Naidu said on Monday that the Centre has finalised rules for the Real Estate (Regulation and Development) Act, which will be communicated to the states soon, allowing them to set up regulators for the sector.

Parliament had passed the bill in March, to regulate the real estate sector, bring transparency and help protect consumer interests.

"The Real Estate bill has already been approved and we have finalised the rules too. Now, we will communicate to the states shortly and the states have to appoint regulators within a period of six months... it will be a reality now," Mr Naidu said on the sidelines of 'India Habitat III-National Report' release event.


Emphasising that the Act brings in transparency and accountability in the real estate sector, he urged the private sector to join hands with the Centre to meet the shortage of houses in the country.

"This is a regulation and not a strangulation. We want the private sector to join in a big way to take on the challenge of housing shortage in the country."

The Real Estate Act is touted as a major reform measure to regulate the vast real estate sector and bring order in it.

It will help establish state-level Real Estate Regulatory Authorities to regulate transactions in both residential and commercial projects and ensure timely completion and handover of those. It will also be required to dispose of complaints within 60 days.

Among other provisions, the Act prohibits unaccounted money from being pumped into the sector and from now, 70 per cent of the money has to be deposited in bank accounts through cheques.

25-year-old Ram Naresh came to Mumbai 10 years ago and has been a construction worker ever since. But the last one month has been a trying one for Ram and his family. Since demonisation, the daily wage labourer's income has dropped to a third of what he was earning before.

"We need at least Rs 6,000 per month to survive but ever since demonetisation, we barely got Rs 2,000-2,500 this month. What will we eat?" asked Ram Naresh. (Watch)

Most of the labourers at Ram's site work for daily wages. With no permanent address listed under their names and since they don't hold bank accounts, they can accept payments only in cash. This has rendered them helpless. Their employers are also facing retention issues. With daily withdrawal limits falling short, paying wages has become nearly impossible.


"Initially, soon after demonetisation, we stood in the bank queue and deposited our money but then we couldn't withdraw enough cash from the bank to pay for buying our materials. We are not being able to pay our labourers also, so they might just leave my work and go," said labour contractor Kamlapati Mishra.

But the problem doesn't end there. Since the note ban, the real estate sector has seen a substantial dip in the number of sales. Queries about projects and walk-ins have dropped by 50 per cent. Buying decisions have also been put on hold in these times of uncertainty.

"Ever since demonetisation, even the inquiries about projects that we used to receive have stopped. We understand that most customers are busy worrying about running their homes at the moment, but hopefully the situation will improve," said developer Suryakant Upadhyay.

But experts believe that after the initial setback, the real estate sector will bounce back with greater transparency and bigger investments.

"The immediate trend...in 3-6 months we will see a slowdown in sales and some price pressure in some pockets or segments. But after that what we strongly believe is that with demonetisation, the real estate residential segment mainly, will evolve in a different manner, said Dr Samantak Das, chief economist and national director of research at Knight Frank India.

"It will be much more transparent and we will definitely see a lot of institutional participation in terms of funds. Because of more transparency, the institutions will have more confidence in this sector," he added.

While developers and construction firms can survive on optimism in the near future, it's the workforce of labourers, who live from one day's wage to the next, who have been worst affected.

ON the Monday after Diwali, the last transaction a realtor oversaw in Mumbai was the re-sale of a two-bedroom home, with a carpet spread of 700 square feet. The apartment, in a 30-year-old high-rise, went for Rs 3.80 crore, roughly the market price in the south-central Mumbai belt. The price of the asset was calculated at 47 per cent below the ready-reckoner rate and fixed at Rs 1.80 crore. The rest, Rs 2 crore, was paid in cash. This “adjustment”, realtors say, is not an anomaly; it is the practice, the usual method to break the cash and cheque components in a re-sale.

Rs 500 and Rs 1,000 currency notes took the cash out of his wads, but realtors believe that the move will shake up the sector over the next 12-18 months and shape it up in the long term.
While a 2012 white paper on ‘black money’ by the Finance Ministry stated that the real-estate sector in India constitutes almost 11 per cent of the GDP, a recent report by Ambit Capital said India’s ‘black economy’ stands at over Rs 30 lakh crore or about 20 per cent of the total GDP. If the ministry’s 2012 assessment holds true today, then real-estate accounts for more than 50 per cent of the current black money market. Which is why, real-estate developers and experts say, the recent demonetisation leaves the industry at the crossroads. Where it goes from here on, they say, is anybody’s guess.

For the real-estate sector, while the pulse still remains the primary market that involves deals between the developer and the buyer, it’s the cash-rich-investor-driven secondary market involving re-sales that sets the rules.
“The impact is likely to be seen in secondary markets for all asset classes, thereby making real estate more illiquid for some time,” says Anshul Jain, MD (India) of Cushman & Wakefield, a leading real-estate services company.
“This decision will have a significant impact on the real-estate industry,” says Pravin Bavadiya, CMD of City Estate Management, a leading real-estate broker in Ahmedabad. For the last few days, since the demonetisation announcement, Bavadiya has been sitting in his posh office on Gurukul Road, fielding calls from people who seek his advice on where to park their cash — devalued notes of Rs 500 and Rs 1,000. “Most of these land deals are now likely to be cancelled or renegotiated. People have been asking me if they can make a back-dated real-estate booking or if they can exchange gold for property,” says Bavadiya, adding, “In Ahmedabad, only 20 per cent of developers accept cheques for 100 per cent of the value of the property. However, the cash component is higher for commercial real-estate dealings.”

A report released on Thursday by credit rating agency Fitch points out that the government’s move will have a negative impact on home-builders over the next 12-24 months. “We expect residential property prices and property sales to fall, as consumers attempt to work out how best to declare their wealth. The negative impact is likely to be more pronounced on sales of higher-end, premium property, which is targeted by high-net-worth individuals and investors, rather than entry-level housing targeted by first-time home-buyers,” says the Fitch report.
For now, at least in public, developers have been putting up a brave face, calling the demonetisation exercise a “fantastic move” and even going on to say that “liquidity will improve”.
“It will lead to some amount of correction in real-estate prices in markets where substantial speculative investments have been made by individuals through black money,” says Jain of Cushman & Wakefield.
Vicky Nagrani, a partner in Rock Realty, a two-decade-old realty firm in Pune, believes the move will increase the availability of cash in the market. “The long-term effect of this will definitely be good. Prices, we think, will remain realistic,” he says. Rough estimates show that for a city like Pune, around 30-35 per cent of the real-estate business involves cash.
Developers say their phones have stopped ringing since the recent announcement — a sign that all’s not well.
Prashant Vedprakash Pandey, who owns Dream House Properties and Real Estate in Mumbai, says, “A deal may or may not take place. But enquiries are important. They make up our actual bread and butter. That is how realty mornings begin.”
Pandey, who deals in rentals between South Mumbai and Dadar and has some ‘A-Listers’ in his client base, says property rates had hardened in the last few years and sales were low. The base rate for a Cuffe Parade flat today is Rs 6 crore, “without parking”, he says. “I could seal only one deal in recent days, and that should say how tough the market is.”
Last year, the Associated Chambers of Commerce and Industry of India (ASSOCHAM) released a report that said that over 75 per cent of the 3,540 real-estate projects, with investments worth over Rs 14 lakh crore, across the country are non-starters. The study also revealed that in Punjab, a majority of real-estate projects were delayed by more than 36-40 months on an average. The situation was similar in Haryana, with a large number of real-estate projects in Delhi’s National Capital region (NCR) non-starters.
With no cash left for at least an interim period, realtors such as Pandey expect this already sluggish secondary market to slow down further.
In an actual end-user purchase, where the buyer is selling an old property to upgrade to new, the cash component is more. For instance, they would sell their space in south Mumbai to buy a larger space in Lower Parel, Andheri, or even in other states. Analysts predict that the demonetisation exercise will see such purchases taking a hit, for at least a year or two.

Rs 1,000 and Rs 10,000 currency notes to curb black money, the real-estate sector has undergone drastic changes. Inflation and standard of living aside, the realty boom has grown unevenly. It’s probably the only sector which sees hard cash taking the weight of high skyscrapers.
Realtors say that from the early 1990s up to 2004, the price escalation in the sector was only up to 5 per cent. The Congress government’s decision to release blocks above 4,000 square metres under the Urban Land Ceiling Act, coupled with foreign investments and tax holidays, changed things.
This growth also set the scene for blackmarketing. Investors “who never planned to live” in these houses purchased in bulk. Between 2008 and 2011, even with inflation going up, blocks of apartments in under-construction properties exchanged hands and hard cash.
Analysts say many of these transactions were shown as moveable properties to avoid capital gains tax. “Against let’s say a sale of 100 shares, the profit proceeds can be put in the real-estate sector to avoid tax. This was where the cash component also played out,” says a Mulund-based investor.
Many of these properties, even after having changed hands several times, maintained no registration records.
Unrealistic land prices added to the problem. Speaking about a project he was associated with, a Worli-based real-estate agent says, “This developer in South Mumbai purchased land in 2002 for an FSI (floor space index) rate of Rs 2,200 per square feet. Today, a flat in the project – it has a French name – costs Rs 93,000 per square feet. Recently, a three-bedroom, 2,900-square-foot flat there was sold for Rs 27 crore. Such a big amount will never come in white.”
Explaining the mechanism of black money transactions in the real-estate sector, Vikram Wadhwa, a real-estate consultant in Chandigarh, says, “Property prices inflate when dealers book a property and then sell it at a higher price. For instance, the government notified rate of a 1 kanal house is Rs 3.25 crore. But it is sold in the market for Rs 6 crore. It’s the buyer who pays this margin in cash. The current demonetisation will make it extremely difficult for any buyer to pay in cash. The seller will also not accept such money. This will automatically bring down property prices.”
A new trend that has picked up over the last year is “exhibition sale”, says a small-time developer. “It used to happen in smaller markets, but has picked pace in prime markets too. Builders would make block purchases from other builders and everyone would be happy. The first builder would get cash and the second builder would make a profit by selling the property during completion. In records, it was shown as a temporary loan, without interest, between the two builders and the loser in this was only the second-sale purchaser if he turned out to be an actual end user. The cash component here was huge too,” says a developer.
A research paper on real estate by Kotak Institutional Equities — released on Wednesday — starts with a warning, “Only individuals with large sums of unaccounted cash will be affected by the government’s move. In real estate, we believe most of the cash is used in land transactions (by entities or individuals) and sellers potentially hold un-explainable sums. Post the Income Declaration Scheme 2016, and the recent government doctrine, we believe it could be difficult for them to adjust such huge sums of cash.” However, it adds that with secondary market showing some correction, and with private equity encouraging governance and transparency, the primary market could see a correction.
The report shows Delhi’s NCR and the Mumbai Metropolitan Regions could be worst affected as opposed to markets in Bangalore, Pune, Chennai and Hyderabad since Delhi and Mumbai have a higher proportion of investors.
Yashwant Dalal, President, Estate Agents Association of India, believes the recent demonetisation has “only brought the spotlight back” on an industry that was already slowing down. “The Real Estate Regulatory Act (which aims to protect the interests of buyers and which was passed by Parliament in March), is anyway going to wipe out small builders. The money that was rotating had slowed and with this demonetisation, things will only slow down further. At least 30 to 40 per cent of the prices are expected to fall in the coming days. In the long term, some correction should happen,” he says, before adding, “Real-estate market works on unwritten rules. It’s like the film industry. There is no logic here.”

When 26-year-old Mani Sharma moved from Jaipur to Gurgaon last month to take up a job as an analyst with CarDekho, her biggest worry was how to find a decent place that she could afford.

It turned out to be far easier than she had imagined. She went online, and quickly found a new concept that’s fast catching up in metros and coaching hubs like Kota: ‘co-living’.

“I received a mail from the service provider, with my check-in date and details of the coordinator, who picked me up from the station. I was pleasantly surprised to see the accommodation… clean, well-lit and furnished,” says Sharma, who is currently living at a Fella Homes property in Sector 45, Gurgaon.

A bunch of startups – in Gurgaon and Bengaluru – is growing a market for organised rentals. They take over properties, furnish them and then rent them out to people. You can take one room, or share it with someone — the choice is yours.

When you move in, you won’t have to worry about Wi-Fi, or buy a TV, a fridge or a microwave. You basically move into a ready place, and there are options tailormade for different budgets, with rents starting at Rs 8,000 a month and going up to Rs 30,000.

At present, there are four startups that focus on co-living operating out of Gurgaon, and two based out of Bengaluru. The four Gurgaon start-ups – Fella Homes, CoHo Stayz, Wudstay and Ziffy Homes – have between them 575 properties of varying sizes – from 20 rooms, to three – in NCR. The two Bengaluru players are NestAway and Square Plums.

Considering the large number of young people moving to Gurgaon for work, these players say they are eyeing massive growth in the coming days. “Co-living, as a concept, is gaining popularity across the globe. Some of the accomplished international players in the space are WeLive (US), Common (US) and You+ (China). In India, it is a $10-billionplus market,” says CoHo Stayz founder Uday Lakkar.

Taking inspiration from US-based WeLive, CoHo focuses on community living and builds, what Lakkar calls, “social experiences for its customers”. The properties are divided into three types — villas, dorms and apartments. While villas and flats are developed keeping working professionals in mind, dorms are meant mostly for students.

More than anything else, it’s the convenience of a maintenance service and a prompt grievance redress system that youngsters find most enticing. “The best part is I don’t have to worry about a broken switch or my cooking gas running out. I just use my app to raise a request and it is attended to within hours,” says Smriti Anand, who lives in a CoHo Stayz property.

ZiffyHomes, too, takes up properties from owners or developers, furnishes and manages them for a commission. “We take a property, develop it and then manage it for the owner. The commission would be 30-35% for the unfurnished property and 10% for a furnished one,” says Sanchal, co-founder, ZiffyHomes.

Wudstay works on a different model. It owns the properties it rents out. “The initial investment may be a little high, but we are building assets. And we cover the cost soon enough,” says Praful Mathur, founder and CEO of Wudstay. To push their ventures, Wudstay had raised $3 million in August last year from Mangrove Capital, while Fella Homes raised $2 million in July this year.

ZiffyHomes raised an undisclosed amount from real estate investors in August. CoHo Stayz is backed by a group of entrepreneurs and investors and is looking for its Series A funding. NestAway, on the other hand, enjoys the backing of Ratan Tata.

kathputli: kathputli colony residents in delhi allege coercion for demolition, Real Estate News, ET RealEstate

NEW DELHI: A section of residents of Kathputli colony today demanded the removal of "heavy police force" deployed for the ongoing relocation drive while alleging that they were being "coerced" into giving demolition clearance.

A group of residents, assisted by NGOs like NAPM, placed their demands and shared grievances at a press conference here which also saw a few tense moments as DDA started demolishing a wall, claimed organisers.

"The wall belongs to DMRC. DDA started demolishing it as soon as the presser started claiming it had the necessary clearance from metro authorities. But DMRC did not take the consent of local people while giving the go ahead. Later, they had to retreat under public pressure," Amit Kumar of NAPM's Delhi unit said.

Aggrieved people told the media that the process through which consent for demolition, for subsequent redevelopment, was being taken was "opaque" and that laid down norms were being violated.

They demanded that police personnel be moved out of the area and the DDA camp be shifted out of the colony.

"Each eviction slip has to be signed by the jhuggi dweller concerned, that person's neighbour and the pradhan. But in many cases, the neighbours and the pradhan are being kept in the dark," Kumar said.

The recent DDA drive to temporarily shift the residents of the colony to a transit camp for its in-situ redevelopment started on December 19.

In a letter to Union Urban Development Minister Venkaiah Naidu, Delhi Minister Satyendar Jain has alleged that the residents were being "forced" to sign eviction slips and they are facing "homelessness".

In 2009, DDA had signed an agreement with a private developer for "in situ slum development" of the colony spread over 5.2 hectares of land.

The project proposes to resettle the resident families in multi-storey flats and the remaining land would be given for commercial purposes.

A day after Prime Minister Narendra Modi stressed on an "incisive" law against Benami property, a top finance ministry official said the government will do everything to strengthen the institutions required for effective operationalisation of the law.

"Whatever is required to strengthen the institutions to make the Benami law more effective, we will do that," the official said here.

In his 'Mann Ki Baat' address, Modi yesterday said the law against Benami property will be turned into an 'incisive law' to deal with such properties.

Observing that earlier governments did not operationalise the Benami property law, which was enacted in 1988, Modi had said it "just lay dormant gathering dust".

"We have retrieved it and turned it into an incisive law against Benami property. In coming days, this law will also become operational. For benefit of the nation, for benefit of people, whatever needs to be done will be accorded our top priority," he said.

GURGAON: Huda is considering postponement of its plan to launch new residential sectors in Pataudi and Farrukhnagar areas of Gurgaon district, fearing losses due to the slump in the real estate market after demonetisation.

Huda is planning to launch new sectors in Pataudi and Farrukhnagar by acquiring 800 acre of land in seven villages. For that, the authority expected to spend around Rs 1,875 crore — around Rs 1,375 crore as compensation to be paid to land owners, another Rs 500 crore to develop the sectors. But after demonetisation, the authority realised it would not be able to recoup enough from selling plots to cover its investment.

Notification for acquisition of the land was issued three years ago. As per the rule, if Huda fails to announce the compensation by December 29, 2016, the acquisition will stand null and void.

Huda was planning to launch the new sectors to help it tide over a deep financial crisis. Officials said they were worried about the possibility of incurring loss from the launch of new sectors, in case they failed to get the desired price for the plots. “The amount required for acquiring the land is quite high. We’ve forwarded the matter to Chandigarh,” said Huda administrator Yashpal Yadav, adding a meeting will soon be called to take a final call on the land acquisition.

Real estate expert Pradeep Mishra said market sentiment is down after demonetisation, and there are few buyers.

“This is not a good time to launch new sectors in Farrukhnagar and Pataudi,” said Mishra, adding that with few property buyers for even Gurgaon, finding buyers in Pataudi and Farrukhnagar would be very difficult.

He said with strict crackdown on unaccounted for cash and stringent rules under Benami Property Act, people have gone into wait-and-watch mode.

“The real estate market was driven by people who invested their excess money in real estate for quick returns. With uncertainty in the market, investors have gone into wait and watch mode,” said Mishra. Huda’s plan, to launch new sectors in Haryana’s other urban areas, has also been affected by the real estate slump.

“The plan to launch new sectors elsewhere across the state, is also likely to be postponed or delayed,” said senior Huda official.

केंद्र सरकार 1 अप्रैल से इस स्कीम की शुरुआत कर सकती है। अभी सरकार इस बेटरमेंट फीस को वसूलने के तरीकों पर विचार कर रही है। इस चार्ज की वसूली स्थानीय निकाय और डिवेलपमेंट अथॉरिटीज के द्वारा की जाएगी। वीसीएफ की व्यवस्था पब्लिक फाइनैंसिंग पूल जैसी है। माना जाता है कि शहरी इलाकों में भूमि की बढ़ती कीमतों और तेज आर्थिक विकास के चलते इंफ्रास्ट्रक्चर में बड़े पैमाने पर निवेश करना पड़ता है।

इस पॉलिसी के तहत सरकार कुछ अतिरिक्त टैक्स लगाने जैसे कुछ तरीके अपनाती है। फिर इस राशि को भविष्य के इंफ्रास्ट्रक्चर प्रॉजेक्ट्स में लगाया जाता है। इस स्कीम के तहत संभावित इंफ्रास्ट्रक्चर से इलाके में प्रॉपर्टी की कीमतों में होने वाले इजाफे का भी आकलन किया जाता है। यह आकलन मेट्रो, स्पीड रेल, हाईवे, पोर्ट्स और एयरपोर्ट्स जैसे प्रॉजेक्ट की फीजिबिलिटी रिपोर्ट तैयार किए जाने के वक्त होता है।

बेटरमेंट फीस की वसूली लगभग 5 साल या फिर तब तक की जाती है, जब तक कि प्रॉपर्टी की कीमतों में स्थिरता न आ जाए। कुछ देशों में इंफ्रास्ट्रक्चर के लिहाज से कई जिलों को ही तय कर दिया है, जिनसे बेटरमेंट फीस वसूली जाती है। इस जोन में रहने वाले लोगों से अडिशनल टैक्स वसूला जाता है ताकि किसी भी परियोजना की लागत को हासिल किया जा सके। एक विकल्प यह भी होता है कि सरकार ऐसे इलाकों में लैंड पूलिंग करे और निश्चित परियोजनाओं के विकास के बाद बची हुई भूमि को वह प्रीमियम रेट्स पर बेच दे।

घर खरीदने वालों को दाम घटने की उम्मीद, प्रॉपर्टी सेल्स पर पड़ेगा बुरा असर

हाउजिंग फाइनैंस कंपनियों ने रेग्युलेटर नैशनल हाउजिंग बैंक (NHB) के साथ हुई मीटिंग में पिछले महीने की शुरुआत में घोषित किए गए डीमॉनेटाइजेशन के चलते रियल एस्टेट सेक्टर में दबाव को कम करके बताया। लेकिन, उन्हें डर है कि कन्ज्यूमर सेंटीमेंट कीमतों में गिरावट की उम्मीद कर रहा है, जो आने वाले महीनों में होम सेल्स पर असर डालने के साथ ग्रोथ को कमजोर कर सकता है। घटनाक्रम की जानकारी रखने वाले कई सूत्रों ने यह बात इकनॉमिक टाइम्स को बताई है।


डीमॉनेटाइजेशन के असर का आकलन करने के लिए पिछले दो हफ्तों में NHB ने दिल्ली, मुंबई और चेन्नै में 81 हाउजिंग फाइनैंस कंपनियों के साथ तीन मीटिंग्स की है। नेशनल हाउजिंग बैंक के सीईओ श्रीराम कल्याणरमन ने इकनॉमिक टाइम्स को बताया, ‘डीमॉनेटाइजेशन के बीच स्थिति का आकलन करने के लिए हमने हाउजिंग फाइनैंस कंपनियों की रीजनल लेवल कॉन्फ्रेंस की है।’ उन्होंने बताया, ‘हमने इस सेक्टर में चुनौतियों, अवसरों के बारे में और हाउजिंग फाइनैंस कंपनियां (HFC) कैसे 2022 तक सभी लोगों के लिए घर के लक्ष्य को पूरा करने की दिशा में काम कर सकती हैं, इस पर विचार-विमर्श किया गया है।’


कल्याणरमन ने चुनौतियों के बारे में विस्तार से नहीं बताया, लेकिन मीटिंग में हिस्सा लेने वाले कुछ लोगों ने बताया कि उन्होंने रेग्युलेटर का ध्यान कीमतें घटने को लेकर कन्ज्यूमर की बढ़ती उम्मीदों की ओर खींचा। एक बड़ी HFC के हेड ने बताया कि रेंटल यील्ड और मॉर्गेज लोन यील्ड में करीब 3.4 फीसदी (टैक्स अडजेस्टेड) की गिरावट आई है, जो अभी किराये के घरों में रहने वाले लोगों की तरफ से हाउजिंग डिमांड को बढ़ाने में अहम भूमिका निभा सकता है।


कई कन्ज्यूमर्स ने फिलहाल घर खरीदने के अपने फैसले को रोक रखा है, क्योंकि वह कीमतों में गिरावट की उम्मीद कर रहे हैं। उनका कहना है कि इसका असर होम लोन डिमांड पर पड़ सकता है, ऐसी कयासबाजी खत्म करने के लिए उन्होंने NHB के दखल की मांग की है। रेग्युलेटर का मानना है कि घरों की कीमतों में थोड़ा शॉर्ट टर्म करेक्शंस (10-15%) देखने को मिल सकता है, लेकिन असल टैक्सपेयर्स के ट्रांसपैरेंट डील्स के लिए आने पर घरों की कीमतों में तेजी देखने को मिलेगी।

ज्यादातर लोगों को लग रहा है कि 2,000 और 500 रुपये के नए नोटों की कमी इसलिए हुई क्योंकि प्रिंटिंग प्रेस मांग के मुताबिक नोट छाप ही नहीं पा रहे हैं। लेकिन, रिजर्व बैंक ऑफ इंडिया (आरबीआई) के आंकड़े कुछ और ही कहानी बयां कर रहे हैं।

आप शायद यकीन नहीं कर पाएं कि 8 नवंबर को नोटबंदी की घोषणा से पहले 2,000 रुपये के जितने नोट छप चुके थे, आरबीआई ने लोगों के बीच बांटने के लिए उतने नोटों को भी 19 दिसंबर तक रिलीज नहीं किया था। ऐसे में सवाल उठना लाजिमी है कि किसने और किन परिस्थितियों ने कैश की इतनी कमी पैदा की जिससे न केवल आम लोगों को मुश्किलों का सामना करना पड़ा बल्कि अर्थव्यवस्था की रफ्तार भी मंद पड़ गई? तो चलिए, आगे देखते हैं कुछ तथ्य...

कितने नोट छपे, बैंकों को कितने मिले?
आरबीआई ने 19 दिसंबर तक विभिन्न बैंकों को 2,000 और 500 रुपये के कुल 220 करोड़ नोट दिए थे। इनमें 90 फीसदी 2,000 रुपये के नोट थे और बाकी 10 फीसदी 500 रुपये के। यानी 19 दिसंबर तक 4.07 लाख करोड़ रुपये मूल्य के नए नोट बैंकों को मिल पाए, जबकि अनुमान है कि इस समय तक करीब 7 लाख करोड़ रुपये मूल्य के नोट छप चुके थे। आरबीआई ने एक आरटीआई के जवाब में बताया है कि उसने 8 नवंबर से पहले ही 4.94 लाख करोड़ रुपये मूल्य के 2,000 रुपये के नए नोट छाप लिए थे। केवल यही आंकड़ा बैंकों को 19 दिसंबर तक दी गई रकम से करीब 1 लाख करोड़ रुपये ज्यादा है।

8 नवंबर को नोटबंदी की घोषणा के बाद भी नए नोटों के छपने का काम जारी रहा और माना जा रहा है कि इस दौरान प्रिंटिंग प्रेसों ने पूरी क्षमता के साथ नोट छापे। नोट छापने वाले देश के कुल 4 प्रिटिंग प्रेसों की क्षमता के मद्देनजर नवंबर के दूसरे सप्ताह से करीब-करीब 2 लाख करोड़ रुपये मूल्य के 2,000 और 500 रुपये के नोट छप गए होंगे। अब इसे 8 नवंबर से पहले के नोटों के साथ जोड़ दें तो 19 दिसंबर तक करीब-करीब 7 लाख करोड़ रुपये (8 नवंबर से पहले के 4.94 लाख करोड़ + उसके बाद के 2 लाख करोड़ रुपये ) मूल्य के नए नोट छप चुके थे। अब सवाल यह है कि जब 19 दिसंबर तक करीब 7 लाख करोड़ रुपये मूल्य के नोट छपे थे तो इस अवधि तक सिर्फ 4.07 लाख करोड़ रुपये ही बैंकों तक क्यों पहुंचे?

ब्लैक मनी पर स्ट्राइक करने के बाद पीएम नरेंद्र मोदी इशारा कर चुके हैं कि उनका अगला निशाना बेनामी संपत्ति पर होगा। बेनामी सौदों को रोकने के लिए बनाया गया कानून 1 नवबंर से प्रभाव में आ चुका है। नए सख्त कानूनों के बाद से लोग प्रॉपर्टी जब्त होने से बचाने के लिए लॉ फर्म्स का सहारा लेने की सोच रहे हैं लेकिन जांच के डर से वह वकीलों से सीधे बात भी नहीं कर रहे हैं।

वरिष्ठ वकील परिमल श्रॉफ ने बताया, 'ब्लैक मनी पर कार्रवाई के बाद लोगों में डर बैठ गया है कि अब अगला निशाना बेनामी संपत्ति पर होगा। लोग पूछ रहे हैं कि नए कानून के तहत सरकार किस हद तक ऐक्शन ले सकती है। लोग पूछ रहे हैं कि कैसे नए कानून में प्रॉपर्टी जब्त होने से बचाई जा सकती है।' बेंगलुरु की लॉ फर्म के वरिष्ठ मेंबर ने बताया, 'मुझे बेनामी कॉल्स आ रही हैं। प्रॉपर्टी जब्त होने के डर से क्लाइंट असली पहचान भी नहीं बता रहा है।'

सरकार ने अगस्त 2016 में बेनामी सौदा निषेध कानून को पारित किया था। इसके प्रभाव में आने के बाद मौजूदा बेनामी सौदे (निषेध) कानून 1988 का नाम बदलकर बेनामी संपत्ति कानून 1988 कर दिया गया है। संशोधनों के बाद सरकार को यह अधिकार है कि वह टैक्स से बचने के लिए दूसरे के नाम से खरीदी गई प्रॉपर्टी को जब्त कर सकती है। लोग वकीलों से इस बारे में पूछताछ कर रहे हैं लेकिन जांच से बचने के लिए वह दोस्तों या अन्य लोगों के नाम का सहारा ले रहे हैं।

क्या है बेनामी संपत्ति?
जैसा नाम से समझ आता है बेनामी का अर्थ ऐसी संपत्ति है जो असली खरीददार के नाम पर नहीं है। टैक्स से बचने और संपत्ति का ब्यौरा न देने के उद्देश्य से लोग अपने नाम से प्रॉपर्टी नहीं खरीदते। जिस व्यक्ति के नाम से यह खरीदी जाती है उसे बेनामदार कहते हैं और संपत्ति बेनामी कहलाती है। बेनामी संपत्ति चल या अचल दोनों हो सकती है। अधिकतर ऐसे लोग बेनामी संपत्ति खरीदते हैं जिनकी आमदनी का स्रोत संपत्ति से ज्यादा होता है।

क्या हो सकती है सजा?

अधिकतम सात साल की सजा और प्रॉपर्टी की मार्केट वैल्यू के 25 प्रतिशत तक जुर्माना। जानबूझकर गलत जानकारी देने पर कम से कम छह महीने की सजा। अधिकतम पांच साल की सजा और संपत्ति के बाजार मूल्य का 10 फीसदी तक का जुर्माना।

दिल्ली में अब किसी को भी प्रॉपर्टी का रजिस्ट्रेशन स्टेटस चेक करना हो तो वह सरकार के रेवेन्यू डिपार्टमेंट की वेबसाइट पर जा सकता है। ऑनलाइन सर्च से ना केवल प्रॉपर्टी का स्टेटस बल्कि सेल डीड, मॉगिज और लीज डीड समेत संबंधित डॉक्युमेंट्स भी देखे जा सकते हैं। मंगलवार से शुरू हुई सेवा में दिल्ली के 21 सब-रजिस्ट्रार ऑफिसों के अधीन प्रॉपर्टी रजिस्ट्रेशन को ऑनलाइन उपलब्ध कराया गया है।

ऑनलाइन सिस्टम में राजधानी की परिधि में आने वाली सभी संपत्तियों के आंकड़े होंगे। इनमें वे सभी कॉलनियां और बस्तियां शामिल होंगे जो शहरी संपत्ति पंजीकरण प्रणाली के तहत आती हैं। हालांकि, 21 सब-रजिस्ट्रार दफ्तरों में अभी ऑनलाइन अपडेटिंग की स्थिति अलग-अलग है। लेकिन, बाद में इन सब में रियल टाइम डेटा के साथ-साथ कम-से-कम दो साल पीछे के आंकड़े दिए जाएंगे। सूत्रों ने बताया कि कई दफ्तरों की वेबसाइट पर तो 2002 तक के डेटा अभी से उपलब्ध हैं।

इस पूरी कवायद का मुख्य मकसद संपत्तियों का फर्जी रजिस्ट्रेशन और फील्ड में काम करने वाले रेवेन्यू डिपार्टमेंट के एंप्लॉयीज को आंकड़ों में छेड़छाड़ करने से रोकना है। हालांकि, इसका एक और फायदा है कि सूचनाएं तुरंत मुहैया हो जाएंगी। रेवेन्यू डिपार्टमेंट अब लिगेसी डेटा के अपलोडिंग का काम तेज करने के लिए पूरी प्रक्रिया को ठेके पर देने की कोशिश कर रहा है ताकि पुरानी संपत्तियों की जानकारियां भी उपलब्ध हो सकें।


डिपार्टमेंट की इस पहल का सबसे बड़ा फायदा आम लोगों को होगा जिन्हें संभावित खरीद वाली संपत्तियों का रजिस्ट्रेशन स्टेटस जानने के लिए सब-रजिस्ट्रार ऑफिस की बार-बार दौड़ नहीं लगानी पड़ेगी। एक अधिकारी ने बताया, 'आपको रजिस्ट्रेशन नंबर मिल गया तो आप स्टेटस ऑनलाइन चेक कर सकते हैं।' उन्होंने कहा, 'अगर आपके पास रजिस्ट्रेशन नंबर भी नहीं है तो एक सर्च ऑप्शन के जरिए आप किसी खास सब-रजिस्ट्रार ऑफिस में इलाका, रजिस्ट्रेशन इयर आदि के आधार पर सूचना पा सकते हैं।'

रीयल एस्टेट कारोबारियों के संगठन क्रेडाई (CREDAI) का कहना है कि पीएम नरेंद्र मोदी की ओर से किए गए नोटबंदी के फैसले से हाउसिंग प्राइसेज में 20 पर्सेंट तक का इजाफा होगा। संस्था के मुताबिक अगले एक साल के अंदर नए रेग्युलेटरी बिल और ऊंची लागत के चलते बिल्डर्स नए प्रॉजेक्ट की लॉन्चिंग कम कर देंगे। नए लॉन्च पूरी तरह से बंद हो जाएंगे क्योंकि बिल्डर देखो और इंतजार करो की नीति अपनाने के मूड में हैं, जबकि ग्राहक इस बात के इंतजार में होंगे हाउसिंग प्राइसेज में गिरावट आएगी।

इसके अलावा नए लॉन्च होने वाले प्रॉजेक्ट्स को मंजूरी मिलने में भी वक्त लगेगा। बिल्डर्स को रीयल एस्टेट रेग्युलेटरी ऐक्ट के मुताबिक काम करना होगा, ऐसे में समस्या और जटिल हो जाएगी। क्रेडाई के चेयरमैन इरफान रज्जाक ने कहा, 'हाउसिंग प्राइसेज में 20 से 30 पर्सेंट तक की कमी आने की बात बहुत दूर का ख्वाब है। खासतौर पर बेंगलुरु के बिल्डर 8 से 10 पर्सेंट के मार्जिन पर काम कर रहे हैं। इसमें अब और गिरावट की उम्मीद नहीं की जा सकती।' प्रेस्टिज एस्टेट्स के मुखिया रज्जाक ने कहा कि बीते कुछ सालों से रीयल एस्टेट मंदी के दौर से गुजर रहा है, महंगाई की रफ्तार के साथ इसकी कीमतें नहीं बढ़ी हैं।

रज्जाक ने कहा, 'प्रॉपर्टी सेक्टर में अब कीमतें बढ़ेंगी ही। इसकी वजह यह है कि नए प्रॉजेक्ट्स की लॉन्चिंग सीमित होगी और मांग बनी रहेगी।' गौरतलब है कि पिछले कुछ सालों में सेल कम होने, लागत बढ़ने, कर्ज महंगा होने और अन्य तमाम कारणों से बिल्डर्स ने प्रॉजेक्ट की लॉन्चिंग में कमी कर दी है। इन सभी कारणों से इस सेक्टर को बड़ा झटका लगा है, जो देश की जीडीपी में 7 पर्सेंट तक की हिस्सेदारी रखता है। कृषि के बाद प्रॉपर्टी सेक्टर रोजगार देने के मामले में दूसरे स्थान पर है।

Family Settlement and Partition deed- A thin line of difference

There is often a confusion while seeking partition of properties amongst Hindu families, whether parties should opt for a partition deed or a family settlement. The effect of the both is same-divide the property.
The substantial difference is that of payment of stamp duty and registration of the document recording partition. A family settlement does not require registration and stamping, however partition deed requires both-hence execution of the partition deed is a costly remedy. Many people draw a family settlement, however it is drawn in such a fashion that courts read it as partition deed, thus the consequences of non-registration and non-stamping get attracted. Thus in order to put the binding effect and the essentials of a family settlement in a concretized form, the matter may be reduced into the form of the following propositions:
(1) The family settlement must be a bona fide one so as to resolve family disputes and rival claims by a fair and equitable division or allotment of properties between the various members of the family;

(2) The said settlement must be voluntary and should not be induced by fraud, coercion or undue influence;


(3) The family arrangements may be even oral in which case no registration is necessary;


(4) It is well settled that registration would be necessary only if the terms of the family arrangement are reduced into writing. Here also, a distinction should be made between a document containing the terms and recitals of a family arrangement made under the document and a mere memorandum prepared after the family arrangement had already been made either for the purpose of the record or for information of the Court for making necessary mutation. In such a case the memorandum itself does not create or extinguish any rights in Immovable properties and therefore does not fall within the mischief of Section 17(2) (sic) (Section 17(1)(b)?) of the Registration Act and is, therefore, not compulsorily registrable;


(5) The members who may be parties to the family arrangement must have some antecedent title, claim or interest even a possible claim in the property which is acknowledged by the parties to the settlement. Even if one of the parties to the settlement has no title but under the arrangement the other party relinquishes all its claims or titles in favour of such a person and acknowledges him to be the sole owner, then the antecedent title must be assumed and the family arrangement will be upheld, and the Courts will find no difficulty in giving assent to the same;


(6) Even if bona fide disputes, present or possible, which may not involve legal claims are settled by a bona fide family arrangement which is fair and equitable the family arrangement is final and binding on the parties to the settlement.

1. The appellant filed the instant suit seeking the relief as under:-
"The plaintiff filed a suit for possession to effect that on 24.1.1991, defendant No.1 entered into an agreement to sell suit land measuring 8 bigha 4 biswas bearing khasra No.159/1(1-14),159/3(6-10) khatoni No.476 khewat No.166/136 min vide jamabandi 1991-92 situated at village Tiwala, for a consideration of Rs.1,95,000/- and for delivering the possession of land and getting the registry in favour of the plaintiff and setting aside the judgment Kadian Savita 2014.05.09 14:02 I attest to the accuracy and integrity of this document High Court Chandigarh and decree of exchange dated 16.1.1993 vide which exchanged property by defendant No.1 with defendants No.2 and 3 is illegal and against the facts and not binding upon the rights of plaintiff because it is mere paper proceedings just to defeat the right of the plaintiff and defendant No.2 and 3 have no concerned with the suit land."
The suit was dismissed with costs by the trial Court vide impugned judgment and decree dated 11.06.2003. However, appeal was accepted by the First Appellate Court vide impugned judgment and decree dated 31.3.2009 to the extent that respondent No.1 was directed to return the double amount of earnest money i.e. ` 50,000/- within a period of two months from the date of order.


2. Moreover, keeping in view the facts and circumstances of the case, appellant has been granted the relief of recovery of double the amount of earnest money and in view thereof, this Court is not inclined to interfere in the impugned judgment and decree of the First Appellate Court.
Thus, no substantial questions of law, as raised, arise in this appeal.
Dismissed.

1. Defendant is in second appeal aggrieved against the concurrent findings returned by the Courts below whereby the suit filed by the respondent/plaintiff for recovery of double the amount of earnest money in light of agreement to sell dated 24.09.2005 was decreed by the learned Civil Judge (Sr. Divn.), Ambala vide judgment and decree dated 23.07.2012 and the findings thereof were affirmed by the learned District Judge, Ambala vide judgment and decree dated 18.09.2013. 


2.The sole point that arises for determination before this Court is that whether the respondent/plaintiff was entitled to recover Rs.2 lacs i.e. double the amount of earnest money from the appellant as per the stipulation contained in agreement to sell (Ex.P-1). 3.In view of the settled principles of law that the Civil Court is required to adjudicate the matter on the basis of preponderance of evidence led by the parties, this Court is of the opinion that both the Courts below have rightly decreed the suit of the plaintiff/respondent and no interference is warranted in the well reasoned judgment and decrees passed by the Courts below. In view of the above, finding no question of law much less substantial question of law arising for determination in the present second appeal, the same is hereby dismissed.]                      

JUDGMENT  3 :---

1. he plaintiff gave a token amount of Rs. 1,00,000/¬ in the name of the defendant vide cheque no. 801308 dated 14.07.2008 and the said cheque was handed over to Sh. Sunil Sachdeva and on 16.07.2008, when the defendant returned back from out of station a written agreement was executed between the defendant and the plaintiff. It is further submitted by the plaintiff that she also gave a sum of Rs. 7,00,000/¬ on 16.07.2008 to the defendant out of which Rs. 3,00,000/¬ given in cash and Rs. 4,00,000/¬ was given through cheque bearing no. 811048 dated 16.07.2008. 30 Thus, issue no.1 is decided in favour of plaintiff and against the defendant. 



Defendant had received Rs.8 lacs from the plaintiff and in terms of clause 7 of the agreement dated 16.07.2008, plaintiff is entitled to double the amount of Rs.8 lacs i.e. Rs.16 lacs. 


RELIEF : 31 Plaintiff paid Rs. 1 lac by cheque but the defendant did not get the cheque of Rs.1 lac encashed and has paid back Rs.4 lacs to the plaintiff through cheque. Thus, plaintiff is entitled to receive remaining amount of Rs.11 lacs from the defendant. Plaintiff has claimed pendente lite and future interest @ 18% per annum from 20.09.2008. However, there is no stipulation for payment of interest in the agreement dated 16.07.2008. Accordingly, plaintiff is not entitled to any interest on the suit amount. Thus, decree is passed for a sum of Rs.11 lacs in favour of plaintiff and against the defendant. No order as to costs.

2. Plaintiff had entered into an agreement to sell with the defendant; this was qua 45 sq. yards of property comprising of one room with latrine, bathroom measuring 16 ft. X 25 ft situate in Khasra No. 15 of Village Mandoli; total consideration agreed was Rs. 1,60,000/-; plaintiff had paid the sum of Rs. 50,000/- as an advance/earnest money. In terms of the aforestated agreement, the balance amount of Rs. 1, 10,000/- had to be paid by 25.08.2000, on which date the defendant was required to execute the documents of transfer in favour of the plaintiff before the Sub- Registrar. The plaintiff reached the office of the Sub-Registrar on 25.08.2000 for getting the documents of transfer executed but the defendant did not came there till 1 pm. 




14. It is also relevant to state that the statement of the defendant had been recorded on 24.10.2002 under Order X of the Code of Civil Procedure. In this statement, she had denied the execution of the agreement to sell Ex. PW-1/1; however in her deposition on oath in Court she had admitted this document. On the preponderance of probabilities and after a detailed examination of evidence both oral and documentary the court had held that Ex.PW-1/1 had been executed by the defendant; the plaintiff was entitled to refund of the earnest money i.e. double the amount of `50,000/- which amount of `1 lac was rightly granted in his favour.

"5. That if the first party refuses to sell the said property within stipulated period as mentioned above then the first party shall be liable to pay the earnest money as double to the second party, in case if the second party refuses to purchase the said property within same time then her/his earnest money shall be forfeited by the first party and after it the first party shall have full right to resell the said property to any person at any rate." 



8. This Court is of the opinion that for rescinding the contract, only invocation of Clause 5 and due communication of the same was required; which was duly done, hence the agreement stood rescinded on 24.05.2011. Consequently, twice the amount of the earnest money i.e. Rs.6,00,000/- was payable to the purchaser. The seller had got the demand draft of Rs.3,00,000/- prepared on 3rd June, 2011. Although the time frame for refund was not mentioned in the agreement, he has nevertheless shown his readiness and willingness to repay the money. The offer to repay Rs.6,00,000/- along with 18% interest thereon is, in the opinion of this Court, fair and adequate. In view of the preceding discussion, the impugned order is set aside, the appellant is directed to pay Rs.6,00,000/- with interest thereon at the rate of 18% per annum from 24.5.2011 and costs of Rs.1,00,000/- to the respondent within 4 weeks from today.

Supreme Court Ordered to refund the Bayana as per terms of Agreement to Sell, with interest




1. "Tukaram Devsarkar aged about 65, Agriculturist R/o Devsar, purchaser (GHENAR)- Balwantrao Ganpatrao Pande aged 76 years r/ o Dijadi Post Devsar, Vendor (DENAR), who hereby give in writing that a paddy field situated at Dighadi Mouja, Survey No. 7/2 admeasuring 3 acres belonging to me hereby agree to sell to you for Rs.2,000 and agree to receive Rs. 1,000 from you in presence of V.D.N. Sane. A sale deed shall be made by me at my cost by 15-4-1972. In case the sale deed is not made to you or if you refuse to accept, in addition of earnest money an amount of Rs. 500 shall be given or taken and no sale deed will be executed. The possession of the property has been agreed to be delivered at the time of purchase. This agreement is binding on the legal heirs and successors and assigns." 



2. While disposing of the suit, the trial court had directed the defendants to pay back Rs. 1,000 plus interest at the rate of 6 per cent per annum from the date of the suit till realisation. In addition thereto, the Civil Judge had required the defendants to pay Rs. 500 as damages to the plaintiff. Keeping this in view, while allowing this appeal, we affirm the decree of the trial court with this modification that the sum of Rs. 500 will also carry an interest of 6 per cent per annum with effect from 8th July, 1977, being the date of the decree by the trial court. This will be in addition to a decree for Rs. 1,000 plus interest at the rate of 6 per cent thereon from the date of the filing of the suit till the date of realisation.

SUPREME COURT JUDGMENT DEFINING EARNEST MONEY. IT SAYS THAT EARNEST MONEY CAN BE FORFEITED AND CAN BE REFUNDED DOUBLE AS WELL IF DEFINED IN THE AGREEMENT TO SELL. 



"Law is, therefore, clear that to justify the forfeiture of advance money being part of ‘earnest money’ the terms of the contract should be clear and explicit. Earnest money is paid or given at the time when the contract is entered into and, as a pledge for its due performance by the depositor to be forfeited in case of non-performance, by the depositor. There can be converse situation also that if the seller fails to perform the contract the purchaser can also get the double the amount, if it is so stipulated. It is also the law that part payment of purchase price cannot be forfeited unless it is a guarantee for the due performance of the contract. In other words, if the payment is made only towards part payment of consideration and not intended as earnest money then the forfeiture clause will not apply."]

A decree of specific performance of agreement to sell dated 12.04.2013 in respect of the suit property is passed in favour of the plaintiff and against the defendant and defendant is directed to execute the sale deed in respect of the suit property in favour of the plaintiff after getting balance sale consideration of Rs.9.5 lacs and get the sale deed registered before the concerned Sub¬Registrar, Delhi. If defendant failed to execute the sale deed in respect of the suit property in favour of the plaintiff, the plaintiff is entitled to get it executed and registered through the court.

All you need to know about Encumbrance Certificate



An encumbrance certificate is needed in a property transaction as an evidence of free title and ownership. It is a document issued by the registration authorities. While buying a property, it is important to confirm that it does not have any legal dues. A prospective buyer must ensure the property has a clear and marketable title. 

'Encumbrance' is the charges or liabilities created on a particular property, whereby it is held as a security for a debt that has not been discharged as on date. An encumbrance certificate contains details of all transactions, and certifies that the property is not mortgaged and has no legal dues. It is obtained from the sub-registrar's office where the deed has been registered. An encumbrance certificate is important while buying property, applying for a home loan or going in for a loan against the property.
Government authorities and financial institutions usually ask for 13 to 30 years' encumbrance certificate. It is issued for a particular period and does not cover any period prior to or following the period mentioned. It is an extract of the register maintained by the sub-registrar, which in turn is based on the documents registered with the registrar. 

In case a particular document is not registered with the registrar, it won't be captured in the encumbrance certificate. There are certain transactions relating to property which are outside its scope. This is because such documents are not compulsorily registrable under the Registration Act 1908.

These include:
Equitable mortgage: This is a mortgage by deposit of title deeds where the borrower deposits the original documents pertaining to the property with the bank and does not get it registered at the registrar's office. 

Testamentary documents and leases: These documents are not required to be registered with the registrar. Any lease for a period of less than one year does not need to be registered. 

Others: Oral tenancy, tax liabilities, prior unregistered agreements, family arrangement, unregistered Will and other unregistered agreements will not show here. 

Need for certificate: In any transaction of sale or purchase of property, a 'no encumbrance certificate' is a very important document. It is also issued for the purpose of mortgaging property for a loan. It certifies that the property is not already mortgaged. 

Obtaining the certificate In order to obtain this certificate, one needs to apply on Form 22 (with Rs 2 non-judicial stamp affixed) to the tahsildar, giving the complete residential address and the purpose for which the certificate is required. A copy of any residence address proof, attested, should be attached. Title details, details of ownership of the property, survey number and address should be mentioned. It is very important that the period, full description of the property, its measurements and boundaries are clearly mentioned in the application. 

The application should be submitted to the jurisdictional sub-registrar's office. The requisite fees needs to be paid. The fee is to be paid year-wise, with any fraction of a year being taken as a full year. The tahsildar will seek a report from the Patwari on whether there is any entry in favour of any person or legal body. In case there is no such entry and the report is favourable, the no encumbrance certificate is issued after conducting a detailed enquiry. The time taken may be anywhere between 15 to 30 days. 

Encumbrance certificates are issued either on Form No 15 or Form No 16. Encumbrance Certificate on Form No 15 records sale, lease, mortgage, gift, partition, release etc that have been registered before the registration authorities and recorded in Book I maintained by the registration authorities for any particular period for which the encumbrance certificate is sought. This helps in verifying the title since certain transactions reflected there, especially in the parent deeds and documents which are not in the possession of the present owner may be applied for and obtained in the form of certified copies. 

The certificate in Form No 16 is issued by the registration authorities only when no transactions have occurred in the period for which the encumbrance certificate is sought.
